Welcome to NightHub! NightHub, Inc. ("NightHub," "we," "us," "our") operates the web site located at and related mobile applications and services (collectively, the "Service"). The Service is designed to provide visitors ("users," "you," "your") with access to listings of bars, clubs and other nightlife offerings in certain geographic areas ("Venues") and facilitate reservations for admission, bottle service, events and related services at such Venues ("Reservations"). This Privacy Policy sets forth NightHub’s policy with respect to information including personally identifiable data ("Personal Data") and other information that is collected from visitors to our Service.

Information We Collect:

When you interact with us through the Service, we may collect Personal Data and other information from you, as further described below:

Personal Data That You Provide Through the Service: We collect Personal Data from you when you voluntarily provide such information, such as when you contact us with inquiries, respond to one of our surveys, register for access to the Service, book a Reservation through the Service or otherwise use the Service. Wherever NightHub collects Personal Data, we make an effort to provide a link to this Privacy Policy. Depending on the Service you use or select, we may request information from you such as your name, age, gender, and city or location and store such information in a user profile.

User Content: We may collect and store information that you and other visitors upload, post, publish, or display through the Service, including without limitation your Venue ratings, reviews, and a list of Venues that you have rated favorably on the Service.

Data about Others: We may also collect and store email addresses and contact information about others that you provide to us through your use of the Service, such as when you use the Service to send invitations to others by email, SMS, MMS, text message or other electronic means for an event at a Venue.

By voluntarily providing us with Personal Data, you consent to our use of it in accordance with this Privacy Policy. You represent that the Personal Data you provide is true, accurate, current and complete, and that you have the authorization to provide it to us. If you provide Personal Data to us, you acknowledge and agree that such Personal Data may be transferred from your current location to the offices and servers of NightHub and the authorized third parties referred to herein located in the United States.

IP Addresses; Device ID Information: The requests you make to NightHub may contain your IP address. We may use visitors’ IP addresses for various purposes, including to recommend Venues based on location; to analyze and report upon the usage of our Service and content, features and services made available through our Service; to diagnose and prevent service or technology problems affecting our Service; and to monitor and prevent fraud and abuse. If you access our Service on a mobile device, we may also collect your device identification number and request access to settings and location information for similar purposes and to personalize your experience with the Service.

Location Information: The Service may collect and use your location information (for example, by using the GPS on your mobile device) to provide certain functionality. We may also use your location information in an aggregate way, as described below in the "Aggregated Personal Data" section.

Non-Personally Identifiable Data: When you interact with NightHub through the Service, we use various technologies such as cookies and web beacons to passively collect information that cannot presently be used to specifically identify you ("non-personally identifiable information"). NightHub may store such information itself or such information may be included in databases owned and maintained by NightHub affiliates, agents or service providers. We may use such information and pool it with other information to track, for example, the total number of visitors to the Service, the number of visitors to each page of our web site, the total number of Reservations for a Venue, and the domain names of our visitors' Internet service providers.

In operating and providing the Service, we use a technology called "cookies." A cookie is a piece of information that the computer that hosts our Service gives to your browser when you access the Service. Our cookies help us provide additional functionality to the Service; personalize your experience with our Service; and analyze Service usage more accurately for research, advertising and marketing purposes. For instance, we may set a cookie on your browser that allows you to access our web site without needing to remember and then enter a password more than once during a visit to the site. In all cases in which we use cookies, we will not collect Personal Data except with your permission. On most web browsers, you will find a "help" section on the toolbar. We also may use Google Analytics to help analyze how users use our Service. This tool uses cookies to collect standard Internet log-in information and visitor behavior information. This information is then used to evaluate visitors' uses of our Service, compile statistical reports on activity on the Service and enhance your experience when you use the Service. Aggregated and/or Anonymous Personal Data: In an ongoing effort to better understand and serve the users of the Service, NightHub may conduct research on its customer demographics, interests and behavior based on the Personal Data and other information provided to us. This research may be compiled and analyzed on an aggregate and/or anonymous basis, and NightHub may share this aggregate and/or anonymous data with its affiliates, agents and business partners, including Venues. This aggregate and/or anonymous information does not identify you personally.

NightHub may also disclose aggregated user statistics and/or anonymous user data in order to describe our users and Services to current and prospective business partners (including Venues and third-party advertisers) and to other third parties for other lawful purposes.

Data from Others: In addition to information you provide through the Service and information we collect passively through cookies and other technologies, NightHub may receive information from Venues about users. For example, a Venue may provide information regarding the behavior of a user who has fulfilled a Reservation with such Venue.

Our Use of Your Personal Data and Other Information:

NightHub uses the Personal Data you provide in a manner that is consistent with this Privacy Policy. If you provide Personal Data for a certain reason, we may use the Personal Data in connection with the reason for which it was provided. For instance, (a) if you contact us by e-mail, we will use the Personal Data you provide to answer your question or resolve your problem (b) if you provide Personal Data in order to obtain access to the Service, we will use your Personal Data to provide you with access to such services and to monitor your use of such services, and (c) if you provide Personal Data in making a Reservation, we will use your Personal Data to facilitate such Reservation by sharing it with the applicable Venue. NightHub and its subsidiaries and affiliates (the "NightHub Related Companies") may also use your Personal Data and other personally non-identifiable information that you submit or we collect through the Service to help us improve the content and functionality of the Service and to better understand our users. NightHub and its affiliates may use this information to contact you in the future to tell you about services we believe will be of interest to you. If we do so, each communication we send you will contain instructions permitting you to "opt-out" of receiving future communications. In addition, if at any time you wish not to receive any future communications or you wish to have your name deleted from our mailing lists, please contact us as indicated below.

If NightHub intends on using any Personal Data in any manner that is not consistent with this Privacy Policy, you will be informed of such anticipated use prior to or at the time at which the Personal Data is collected.

Our Disclosure of Your Personal Data and Other Information:

NightHub is not in the business of selling your information. We consider this information to be a vital part of our relationship with you. There are, however, certain circumstances in which we may share your Personal Data or other information about you with certain third parties without further notice to you, as set forth below:

Venues: Each time you book a Reservation at a Venue through NightHub, we will provide the applicable Venue with access to the information in your user profile and/or entered as part of the Reservation process. We may also provide a Venue with (a) general information regarding your Reservation history and preferences and (b) information that other Venues have provided about you.

Business Transfers: As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Data may be part of the transferred assets.

Related Companies: We may also share your Personal Data with our Related Companies for purposes consistent with this Privacy Policy.

Agents, Consultants and Related Third Parties: NightHub, like many businesses, sometimes hires other companies to perform certain business-related functions. Examples of such functions include mailing information, maintaining databases and processing payments. When we employ another NightHub to perform a function of this nature, we only provide them with the information that they need to perform their specific function.

Legal Requirements: NightHub may disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of NightHub, (iii) act in urgent circumstances to protect the personal safety of users of the Service or the public, or (iv) protect against legal liability.

Your Choices:

You can use the Service to browse listings of bars, clubs and other nightlife offerings and events without providing any Personal Data or completing a user profile. If you choose not to provide any Personal Data, you may not be able to use certain features of the Service.

Response to "Do Not Track" Signals:

At present, we do not respond to "do not track" signals sent from web browsers. If we do so in the future, we will provide all relevant information in this policy.


This Privacy Policy does not apply to any Personal Data collected by NightHub other than Personal Data collected through the Service. This Privacy Policy shall not apply to any unsolicited information you provide to NightHub through the Service or through any other means. This includes, but is not limited to, information posted to any public areas of the Service (collectively, "Public Areas"), any ideas for new services or modifications to existing Services, and other unsolicited submissions (collectively, "Unsolicited Information"). All Unsolicited Information shall be deemed to be non-confidential and NightHub shall be free to reproduce, use, disclose, and distribute such Unsolicited Information to others without limitation or attribution.


As set forth in our Terms of Service, individuals under the age of 18 are not authorized to use the Service. If you are under the age of 18, do not use the Service or submit any Personal Data through the Service. NightHub does not knowingly collect Personal Data from any individual under the age of 18. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Data through this Service. If you have reason to believe that an individual under the age of 18 has provided Personal Data to NightHub through the Service, please contact us, and we will endeavor to delete that information from our databases.

Links to Other Web Sites:

This Privacy Policy applies only to the Service. This Service may contain links to other web sites not operated or controlled by NightHub (the "Third Party Sites"). The policies and procedures we described here do not apply to the Third Party Sites. The links from this Service do not imply that NightHub endorses or has reviewed the Third Party Sites. We suggest contacting those sites directly for information on their privacy policies. For instance, we use a third-party payment processor to accept and process credit and debit card payments when you purchase services via the Service. The information provided to the payment processor is governed by the payment processor’s privacy policy. As of January 2015, NightHub uses Braintree, a division of PayPal, Inc., as our third-party payment processor. We may change the payment processor in the future.

Social Media:

Through the Service, you can choose to link your NightHub account to your accounts with certain social media websites and services that are owned and/or controlled by third parties (including, without limitation, Facebook and Twitter) (such websites and services, collectively, the "Social Media Services"). When you elect to access and use the Social Media Services, you will be sharing your information (which will include personal information if you elect to share such information) with those Social Media Services. As with other Third Party Sites, the information that you share with the Social Media Services will be governed by the privacy policies and terms of service of the providers of such Social Media Services and not by the policies and procedures we describe here. You may also be able to modify your privacy settings with these Social Media Services to, for example, control what information the Social Media Services disclose to other entities, including NightHub. When you link your NightHub account to a Social Media Service account, we will collect relevant information necessary to enable the Service to access that Social Media Service; however, you will provide your login information, like your password, directly to such Social Media Service (and not to NightHub). As part of such integration, the Social Media Service will provide NightHub with access to certain information that you have provided to such Social Media Service, and we will use, store and disclose such information in accordance with this Privacy Policy and, if and to the extent applicable, the policies of such Social Media Services. However, please remember that the manner in which Social Media Services use, store and disclose your information is governed by the policies of the applicable Social Media Services provider, and, as a result, NightHub shall not have any liability or responsibility for the privacy practices or other actions of Social Media Services that may be enabled within and/or otherwise accessible through the Service.


NightHub takes reasonable steps to protect the Personal Data provided via the Service from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet or e-mail transmission is ever fully secure or error free. In particular, e-mail sent to or from this Service may not be secure. Therefore, you should take special care in deciding what information you send to us via e-mail. Please keep this in mind when disclosing any Personal Data to NightHub via the Internet.
